Short term rental rules
The terms of short term rental define the rights and obligations of the Service Recipient ("Client") and the Service Provider – "Two Continents," managed by Hubert Pleskot, located at Kazimierza Króla 16A Street, 04-854 Warsaw, Tax ID (NIP) 9522193787, REGON 382543486, with the electronic address: https://twocontinents.com/en. These regulations apply to the booking and short-term rental of premises offered by "Two Continents," as well as payment rules, complaints, and liability.
Making a reservation constitutes acceptance of the terms of the Regulations, which the Client can review at the electronic address https://twocontinents.com/en and confirm acceptance via a declaration on the reservation form.
Whenever the Regulations refer to:
1. Client: Refers to a natural person with legal capacity under the Polish Civil Code, a legal entity, or an organizational unit referred to in Article 33 of the Polish Civil Code, which is a party to the short-term rental agreement of a premise offered by "Two Continents."
2. "Two Continents": Refers to the Service Provider.
3. Online Service: Refers to the website https://twocontinents.com/en.
4. Agreement: Refers to the set of mutual rights and obligations of the parties arising from the short-term rental agreement.
5. Total Service Price: Refers to the amount indicated during the booking process, covering all charges arising from the Agreement.
6. Force Majeure: Refers to any unavoidable external occurrence that could not have been foreseen or countered, particularly factual, legal, or administrative occurrences, which cannot be foreseen despite all efforts.
I. General Provisions
1. These regulations specify the conditions for booking and short-term rental of premises offered by "Two Continents" and the terms of payment, complaints, and liability of the parties to the Agreement.
2. Proper use of the Online Service requires the following technical requirements:
a. Internet access,
b. An installed internet browser (recommended to have the latest version of Firefox, Google Chrome, Safari, etc.),
c. An active and properly configured email account.

II. Subject of the Agreement
1. The Agreement concerns the short-term rental of premises offered by "Two Continents" through the Online Service.
2. "Two Continents" is obligated to provide the Client with a premise as described on the Online Service and within the dates specified in the reservation. The Client is obligated to pay the Total Service Price determined during the booking process.
3. Making a reservation through the Online Service or intermediary portals equates to acceptance of these Regulations and concludes the short-term rental agreement between the Client and "Two Continents."
III. Booking and Payment Rules
1. During the booking process, the Client selects a premise offered by "Two Continents" through the Online Service and completes the reservation by filling out a virtual booking form available on the Online Service.
2. The Client specifies the start and end dates of their stay under the offer on the Online Service. The stay is calculated in days.
3. Each premise offered by "Two Continents" is intended for a maximum number of occupants as specified in the booking form. The number of persons cannot exceed the maximum capacity designated for the premise.
4. To make a reservation, it is necessary to:
a. Accept the content of the Regulations,
b. Provide mandatory personal data,
c. Click the "Buy and Pay" button,
d. Immediately pay for the booking via:
i. ZEN payment system,
ii. Card payment (Visa, Mastercard, Maestro Secure cards),
iii. Bank transfer to account number 94 1090 1753 0000 0001 4190 5521.
5. During the Order placement – up to the point of clicking "Buy and Pay" – the Client can modify entered data based on instructions displayed on the website.
6. Submitting an Order constitutes a declaration of intent to conclude a Sales Agreement with "Two Continents," per the Regulations.
7. After submitting the Order, the Client receives an email confirming all essential details of the Order.
8. The Agreement is considered concluded upon the Client's payment and receipt of check-in instructions via email.
9. The Order Summary itself does not constitute the conclusion of the Agreement.
10. Within a maximum of 12 hours after payment, the Client will receive either a reservation confirmation or rejection notice.
11. In the event of rejection by "Two Continents," the Client will receive a refund within seven days.
12. Failure to pay as specified in clause 4 grants "Two Continents" the right to withdraw from the Agreement without setting an additional deadline.
13. After payment, the Client has the right to withdraw from the Agreement within 48 hours for a full refund, provided there are more than 30 days between the booking date and the stay start date.
14. Cancellation after the period mentioned in clause 13 results in "Two Continents" charging a fee depending on the number of days from the date of cancellation to the start of the stay:
a) more than 14 days before the start of the stay – 50% of the amount paid;
b) less than 14 days before the start of the stay – 100% of the amount paid.
IV. Terms of Stay in Apartments
1. The stay begins no earlier than 3:00 PM on the first day specified in the Reservation and ends at 11:00 AM on the last day.
2. Late check-out after 11:00 AM is only possible with prior email agreement and consent from "Two Continents."
3. Quiet hours are in effect from 10:00 PM to 6:00 AM.
4. On the day of the stay, the premises and keys will be handed over, and the Client will be familiarized with the premises. "Two Continents" is not liable for delays in handing over the premises due to the Client’s failure to notify their arrival time.
5. Upon check-in and receiving the keys, "Two Continents" has the right to request the Client's ID or passport to record personal data.
6. The Client is obligated to use the premises in accordance with its purpose, the Regulations, and social coexistence principles, particularly without disturbing neighbors.
7. "Two Continents" reserves the right to terminate the Agreement immediately if the Client or accompanying persons behave aggressively or disturb others.
8. The Client must promptly report any defects in the premises to "Two Continents”.
V. Terms of stay in Hotel Atana
1. The room rate includes all taxes except the hotel tax of 15 AED per night for a Standard, Deluxe, or Trio room, or 30 AED per night for a Family room. This fee must be paid upon check-in.
2. Free cancellation of a hotel stay is possible up to 96 hours before the start of the first night.
3. The stay at the hotel begins no earlier than 2:00 PM on the first day specified in the Reservation and ends at 12:00 PM on the last day.
4. The guest is obliged to use the hotel room in accordance with the internal regulations of Hotel Atana.
5. Hotel Atana rooms have the following bed configurations: Standard – 2x single bed or 1x double bed; Deluxe – 1x double bed; Trio – 3x single beds; Family – 1x double bed and 2x single beds.
6. Maximum room occupancy:
• Standard - max. 2 adults + 1 child up to 11.99 years old*
• Deluxe - max. 2 adults + 1 child up to 11.99 years old
• Trio - max. 3 adults + 1 child up to 11.99 years old
• Family - max. 4 adults + 2 children up to 11.99 years old
*Children up to 11.99 years old sleep in the same bed as their parents.
VI. Cancellation of Reservation
1. "Two Continents" and the Client have the right to withdraw from the agreement within 3 days of the occurrence of Force Majeure. The Client is entitled to a refund of all amounts paid.
2. At any time prior to the agreed stay date, the Client has the right to withdraw from the Agreement. If the Client cancels for reasons attributable to them, the Client must cover the cancellation costs in an amount depending on the number of days from the date of cancellation to the start of the stay:
a) more than 14 days before the start of the stay - 50% of the amount paid;
b) less than 14 days before the start of the stay - 100% of the amount paid.
Free cancellation of a hotel stay at Hotel Atana is possible up to 96 hours before the start of the first night.
3. Changing the reservation date or the chosen accommodation during the booking process is only possible by mutual agreement. In the absence of agreement, clause 2 above applies.
4. If "Two Continents," for reasons beyond its control, must change the essential terms of the agreement before the stay begins, particularly changing the reserved accommodation or reservation date, it must immediately notify the Client, who should promptly inform "Two Continents" whether they:
A) Accept the proposed change to the Agreement, or
B) Withdraw from the Agreement, which results in the immediate refund of all amounts paid by the Client.
5. If "Two Continents" discovers damages in the accommodation not noted during check-in, the Client agrees to cover the repair costs. This does not prevent "Two Continents" from seeking compensation under general principles.
VII. Liability
1. "Two Continents" is responsible for non-performance or improper performance of the Agreement unless it results solely from the actions or omissions of the Client.
2. The Client is responsible for any damages caused in the accommodation, especially to its furnishings and fixed elements, due to their actions/omissions or the actions/omissions of persons or animals staying in the accommodation during the Client's stay.
3. The Client is not responsible for damages caused by Force Majeure.
VIII. Complaints
1. If the services provided are found to be inconsistent with the Agreement, all complaints should be submitted in writing or electronically to "Two Continents" within no later than 30 days after the end of the stay.
2. "Two Continents" will review the complaint and inform the Client in the same form: written or electronic.
3. In case of refusal to accept the complaint, "Two Continents" must provide a detailed explanation in writing or electronically.
IX. Animals
As a rule, "Two Continents" does not permit animals in the accommodations.
X. Final Provisions
1. For matters not regulated, the provisions of the Polish Civil Code apply.
2. The Client declares that they have been informed of the content of Article 38(12) of the Polish Consumer Rights Act of May 30, 2014, under which the right to withdraw from a distance contract does not apply to agreements for accommodation services other than for residential purposes.
3. The Client consents, within the meaning of Article 23(1)(1) and (3) in connection with Article 7(5) of the Polish Personal Data Protection Act of August 29, 1997, to the processing, updating, sharing, and storage of their personal data to perform the Agreement.
4. Any disputes between "Two Continents" and the Client will be resolved under Polish law by the competent court in Poland.
